These terms are the agreement between you and Studio Mubold for the use of Words Are Flowing. By creating an account you accept them.
Who we are
Words Are Flowing is made by Studio Mubold, operated by Etienne Bolduc as a sole proprietorship registered in Québec (NEQ 2282295247). Questions about these terms: support@mubold.com. Questions about personal information: privacy@mubold.com.
The service
Words Are Flowing is a hosted feedback loop for apps and games: an SDK you add to your app, an API that receives your users' private notes and anonymous counters, and a portal where you set the rules and read the notes. The documentation describes what it does.
Accounts
Accounts are for businesses and for individuals 16 or older. You are responsible for your account, for keeping your sign-in and your API keys confidential, and for what is done with them. If a key leaks, rotate it from the portal.
Plans and billing
- The plans, their prices in USD and their limits are those on the pricing page.
- Paid plans are sold by Paddle, our reseller and merchant of record. Paddle charges you, calculates taxes and issues the invoice; its buyer terms apply to the purchase.
- Subscriptions renew automatically, monthly or yearly, until cancelled.
- You can cancel at any time from the portal's subscription page or by writing to us. Cancellation takes effect at the end of the period already paid; your plan stays active until then.
- Refunds follow Paddle's refund policy.
- When you delete your account we cancel its Words Are Flowing subscription immediately, so nothing further is charged; refunds follow Paddle's refund policy. If we cannot (for example, you paid with a different email address), cancel it from the link in your Paddle receipt or write to support@mubold.com.
Quotas
Each plan has a monthly number of notes and a number of products. Over the monthly quota, new notes are refused until the next month or an upgrade; the portal shows how many were refused. After a downgrade, your oldest products stay editable and the newer ones beyond the plan's limit become read-only until you upgrade or delete one; rotating an API key is always allowed. Notes are kept for the retention period of your plan, then deleted automatically, as described in the privacy policy.
Acceptable use
You agree not to:
- send special categories of information through the service (health, religious or political beliefs, sexual orientation, biometric or government identifiers, or similar sensitive information);
- use the service to identify the end users of your app beyond what you need to answer or delete their notes;
- use the service in a way that breaks the app stores' rules for review prompts — see our store policy page;
- call or modify the SDK so that a button, or a question shown first, triggers the store prompt;
- attack, overload or try to get around the limits or security of the service, or use it for anything unlawful.
We may suspend an account that breaks these rules. Where we can, we will tell you first and give you the chance to fix it.
Your content
The notes, attributes and configuration you send us remain yours. We process your end users' notes only on your behalf and under the data processing agreement, which forms part of these terms.
Availability
The service is provided "as is". We work to keep it running, but we offer no service-level agreement and do not guarantee that it will be uninterrupted or error-free. The SDK is built so that your app keeps working when the service cannot be reached.
Liability
To the extent the law allows, our total liability for any claim related to the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect losses, such as lost profits or lost data. Nothing in these terms limits a liability that the law does not allow to be limited.
Termination
You can stop using the service and delete your account at any time from the portal. We may end the service or an account for a serious breach of these terms, or end the service as a whole with at least 30 days' notice by email. When an account is deleted, its data is erased as described in the privacy policy.
Changes to these terms
If we change these terms, we will update the date at the top of this page. For significant changes, we will tell account holders by email or in the portal at least 30 days before they take effect.
Governing law
These terms are governed by the laws of Québec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal have jurisdiction, subject to any consumer protection rule that gives you the right to go to your own courts.
